These Terms govern your use of EJJ Language Solutions' medical interpretation and translation platform. Please read them carefully. Our services involve sensitive health information and are delivered in compliance with HIPAA.
By accessing or using the EJJ Language Solutions platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is provided by EJJ Language Solutions LLC ("EJJ", "we", "us", or "our"), a language services company based in Indianapolis, Indiana.
EJJ provides professional medical interpretation and document translation services, including Over-the-Phone Interpretation (OPI), Video Remote Interpretation (VRI), on-site interpreting, and certified/notarized document translation. The Service facilitates connections between healthcare providers, patients, and certified interpreters across Indiana and Kentucky.
The Service supports three user roles: (a) Administrators, who manage operations, scheduling, and billing; (b) Clients, who request interpretation and translation services and manage their organization's account; and (c) Interpreters, who accept and fulfill job assignments. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to use the Service.
EJJ is committed to compliance with the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations. Interpreters and staff are trained on HIPAA privacy and security requirements. By using the Service, you acknowledge that interpretation sessions and translated documents may contain Protected Health Information (PHI), and you agree that EJJ may process such PHI solely for the purpose of delivering language services. EJJ maintains appropriate administrative, physical, and technical safeguards to protect PHI. Clients are responsible for ensuring they have appropriate authorizations and consents in place before requesting interpretation services involving patient PHI.
Clients may submit service requests through the client portal, by phone, or by email. EJJ will use reasonable efforts to match each request with a qualified, certified interpreter. While EJJ strives to fulfill all requests, we do not guarantee interpreter availability for every requested time, language, or location. Urgent and emergency requests are prioritized but are subject to interpreter availability. Estimated durations and scheduled times are approximate.
EJJ engages interpreters who hold relevant certifications and have demonstrated proficiency in their language pairs and areas of specialization. However, clients retain ultimate responsibility for determining whether an interpreter's qualifications are appropriate for a specific clinical or legal encounter. EJJ makes no guarantee that any particular interpreter will be available for a given assignment.
Fees for services are based on the service type, duration, language pair, and urgency, as communicated at the time of booking or per executed service agreements. Invoices are issued after service completion (or per agreed billing cycle) and are due within thirty (30) days of the invoice date unless otherwise specified. Late payments may be subject to additional fees. Disputed charges must be reported within fourteen (14) days of receiving the invoice.
You agree not to: (a) use the Service for any unlawful purpose; (b) submit false or misleading information when requesting services; (c) attempt to gain unauthorized access to any part of the Service, another user's account, or EJJ systems; (d) interfere with or disrupt the Service or servers; (e) share, sell, or misuse interpreter or patient information obtained through the Service; or (f) reproduce, duplicate, or resell EJJ's services without authorization.
The Service, including its content, branding, software, and design, is owned by EJJ and protected by intellectual property laws. Original documents submitted by clients remain the property of the client. Translated deliverables are provided to the client for their authorized use. You may not copy, modify, distribute, or create derivative works from the Service without EJJ's prior written consent.
EJJ recognizes the sensitive nature of information exchanged during interpretation and translation services. All interpreters and staff are bound by confidentiality obligations. Notwithstanding these Terms, EJJ may disclose information when required by law, court order, or government regulation, or to protect the rights, property, or safety of EJJ, its users, or others.
To the maximum extent permitted by law, EJJ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. EJJ's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount paid by you to EJJ for the specific service giving rise to the claim in the three (3) months preceding the event. EJJ does not provide medical advice; interpretation and translation services are provided to facilitate communication only.
You agree to indemnify and hold harmless EJJ, its officers, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights, including HIPAA obligations applicable to your organization.
These Terms remain in effect while you use the Service. EJJ may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including confidentiality, intellectual property, limitation of liability, and indemnification) shall remain in effect.
EJJ may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date below indicates when these Terms were last revised.
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Indianapolis, Indiana, in accordance with applicable rules.
